First of all: there seems to be some kind of misconception among some people, of what capitalism actually is. There are some who believe that where there is a market economy, money and competition, then that’s automatically capitalism. That’s not true. In capitalism there is of course a market economy, but that can exist in other systems as well.

What characterizes capitalism is that there is private ownership of the means of production. That’s when you know you’re dealing with a capitalist system. If this feature is absent, if it’s not the case that some individuals privately own the means of production others are using, then it’s no longer capitalism. If it instead was a system in which, let’s say, the workers themselves controlled and managed the means of production democratically at the place where they worked, and that these institutions were operating in a market system, then that would be some kind of market socialism etc, not capitalism.

And it is this private ownership of the means of production that’s a huge part of the problem. Capitalism is tyrannical, exploitative and dehumanizing; it’s intolerable

A system that allows a few individuals to have undemocratic control and power, not only at the workplace, but in society in general, is unacceptable; a system that allows some individuals to exploit and profit on other people’s misery is unacceptable; a system that allows more and more cash to be shuffled into the pockets of the owners and the wealthy, is unacceptable.

Capitalism IS the problem.

May 20th: Day of Action

Homeowners VS. Banking Execs

Showdown at the Department of Justice

Too Big to Fail, Too Big to Jail?

Millions of underwater homeowners have paid the price for Wall Street's crimes. From mortgage fraud to predatory lending, it's time to put bankers in jail.

Join Occupy Homes, dozens of underwater homeowners, and hundreds of allies from across the country as we take action and risk arrest at the Department of Justice.

Bring Justice to Justice Rally:
May 20th @ 1pm
Gather: Freedom Plaza, 14th Street and Pennsylvania Ave NW – March to Department of Justice @ 1:30pm

With Occupy Homes, Home Defenders League, Campaign for a Fair Settlement, and community and faith leaders

Five years after Wall Street crashed the economy, not one banker has been prosecuted for the reckless and fraudulent practices that cost millions of Americans their jobs, threw our cities and schools into crisis, and left families and communities ravaged by a foreclosure crisis and epidemic of underwater mortgages.

Record profits are back at the bailed-out banks. Meanwhile:

Homeowners and communities have lost billions to Wall Street’s foreclosure crisis;

Millions more families face foreclosure in the coming months;

Communities of color have been impacted the most.

This March, U.S. Attorney General Eric Holder, testifying before a U.S. Senate committee, admitted that big banks and their executives have escaped prosecution simply because they are too wealthy and powerful. "Too big to fail” banks are officially “too big to jail."

The time is now for Congress and the Obama administration to make Wall Street pay us back:

Prosecute Wall Street bankers for stealing our homes, savings and livelihoods;

End the foreclosure crisis;

Reset mortgages to their current value (“principal reduction”);

Restore and rebuild wealth stolen from communities of color hardest hit.

Since the crisis began, Americans from all walks of life have banded together to help each other. Working through community organizations, civil rights groups, the Occupy movement, and community and faith leaders, we have shared our stories, lobbied, petitioned, and even faced arrest for occupying our own homes and demanding justice.

During the Wall Street Accountability Week of Action in Washington, D.C., May 18-23, families on the front line of the foreclosure crisis will travel from around the country to Washington, D.C., to make their voices heard. The week will include community organizing, home-defense training, and non-violence and civil-disobedience training.

On Monday, May 20, at 1:00pm, home defenders, as well as faith and community leaders will rally to Bring Justice to Justice – demanding an end to the “too big to jail” policy, and relief for families and communities devastated by the financial crisis and foreclosure epidemic.

Last week, the richest man in the entire world, Carlos Slim, attempted to use a philanthropic gift to cover up the fact that his monopolistic practices have impoverished all of Latin America, with headway being made to raid the coffers of the United States with over $451.7 million taken in from subsides from the government of the United States every year.

Former Enron CEO and current jailbird Jeffrey Skilling should be out of jail in just four years, skipping nearly a decade of his prison sentence for corporate fraud and graft.

As the world's richest people are prone to do, Skilling is getting out of jail early with a combination of cash payments and legal maneuvers.

In exchange for early release, Skilling is paying Enron's victims some $40 million in shut-up money and has generously agreed to stop suing everyone involved with his conviction and sentence in 2006.

Skilling's promised payments would equal 0.1% of the $40 billion Enron stole under Skilling's leadership. He was originally sentenced to 24 years behind bars, but his total sentence would be half of that if his lawyers get approval on this latest scheme.

Skilling's appeal went to the Supreme Court in 2010, and the justices agreed with his attorneys that the original conviction was "based in part on an invalid legal theory known as the 'theft of honest services.'”

The same judge who sentenced Skilling will rule at the next hearing, on June 21 in Houston.

Occupy Houston, game on.

To artists, gallerists, workers, and fairgoers attending Frieze Art Fair New York:

For the second year in a row, Frieze Art Fair and its subcontractor Production Glue have hired low-wage, non-unionized workers to construct their fair, bringing in people from as far away as Wisconsin. This breaks with the industry standard: the major New York City art fairs including the Armory and the ADAA, as well as many other cultural and business expositions, employ unionized workers to construct and run their shows.

Frieze is a for-profit private event that takes over a municipal public park for two months to serve a global clientele of wealthy art collectors. The fair pays less than $1 per square foot to lease the land from the city. With a ticket price of $42 per day, Frieze is inaccessible to many working New Yorkers. However, despite the cheap rent and high admission prices to an event that generates millions of dollars in art sales (and not to mention the event's main sponsor, Deutsche Bank), Frieze still claims it cannot afford to pay decent wages to local workers.

Labor organizations including Teamsters Joint Council 16, NYC Central Labor Council, IATSE Local 829, IATSE Local 1, NYC District Council of Carpenters, and District Council 9 have all called on Frieze to employ their union members and guarantee local workers a fair, living wage with benefits. This demand has been repeated by City Councilwoman Melissa Mark-Viverito (representing Randall’s Island), as well as City Councilmembers Jessica Lappin and Mark Weprin, and U.S. Representative Carolyn B. Maloney (D-NY12). As Weprin said recently, “Frieze NY Art Fair, or any private business that chooses to use public parks, should hire local New York workers and adhere to fair labor standards.”

If you are an artist or gallerist showing at the fair:

We ask you to refuse to serve as a fig leaf for exploitation. We ask you to decline to lend artistic cachet to an event that does not support New Yorkers, and that desperately needs the stamp of cultural seriousness to justify itself to the public.

Even if you cannot withdraw from the fair at this point, we ask you to consider speaking out publicly against Frieze’s unfair labor practices by making information about this issue available at your booth. We would be glad to provide you with a sign and/or flyers you can display.

We also urge you to tell Frieze organizers that you are an artist or represent artists in the exhibition and that you support organized labor.

If you are attending or work at the fair: Urge everyone you know to contact Frieze to demand they engage in fair labor practices, and consider not attending the fair until Frieze agrees.

It takes courage to speak the truth when many wish to deny it, but rest assured that should you decide to stand up and speak out, you will not be alone.

The arts are an economic engine for New York, bringing millions of people and billions of dollars to the city each year. Yet each year, more jobs become unpaid internships, artists are denied payment for their labor, real wages go down, and benefits are lost; meanwhile, the city becomes more expensive and the distribution of wealth more unequal. We believe in the importance of holding institutions such as Frieze accountable for their impact on New York and the people who live and work here. We want to see art bloom across our city, but we know there is a better, fairer way to foster this growth.

Sincerely,
Arts & Labor

“This is a non-violent direct action, you are not being held in this room, you are free to exit when you please. We no longer recognize your presidency at Cooper as legitimate and in so doing we commit to re-claim this office in the interim until a suitable administrative alternative is secured."

Over 50 students have overtaken the office of Cooper Union President Jamshed Bharucha in response to the Administration and the Board of Trustees announcing the implementation of tuition for the incoming class of 2014- desecrating a 154 year old tradition of meritocracy and free education. "We stand together with the extended Cooper community in opposition to this decision; we reaffirm all of the previous and future actions of our fellow students and allies."

UPDATE: Cooper Union Students are calling for a Solidarity Rally Tonight at 6PM outside the Foundation Building at Cooper Square Park.

The students delivered a Statement of No Confidence from the School of Art, one of the three colleges that make up Cooper Union. Similar Statements of No Confidence are currently in the process of being drafted and voted upon by the School of Architecture and the School of Engineering.

On April 23, 2013, Cooper Union’s board of trustees announced that they will begin charging tuition, ending the university’s 144-year-old mission of providing free education to all those who merited entry. The decision was met with a united uproar of dissent from nearly all sectors of the university community, including students, faculty, and alumni. While it might seem counterintuitive to get behind a relatively small struggle at one of the most exclusive universities in the country—an old-fashioned meritocracy in a world in which a young person’s “potential” is directly proportionate to their family’s economic station—Cooper Union is by far the most diverse of all elite colleges: white students are a minority here and two-thirds of the student body attended public high schools.

Institutions funded by philanthropy and real estate earnings are clearly unsustainable as foundations for a quality education, but the school’s economic problems and its board’s regressive solutions mirror the situation currently taking place at countless other universities, both public and private. From CUNY tuition hikes to the torpedoing of Medgar Evers College to NYU’s unprecedented land grab, students across the city are fighting back. As student struggles continue across the globe, Cooper Union is a flashpoint for something much larger than itself.

Peter Cooper, the school’s founder, railed against the scourge of student debt a century and a half before the streets of Montreal exploded with resistance, before New York universities faced a string of militant occupations, before students in California put their bodies on the line against tuition hikes and the commodification of higher education. The ongoing fight at Cooper Union is but one part of the broader struggle against austerity, debt, and all other symptoms of capitalism.

On May 1, a 36-page mini-zine that serves as a postscript to last year’s Why is Cooper Union Being Occupied? was produced and distributed around the city. Collecting recent articles, editorials, and primary source documents, this basic update outlines the current situation at Cooper Union, at once a eulogy and a call for new resistance.

One of the points Occupy Wall Street made, by choosing to occupy space in Manhattan and not in DC, was that it's really Wall Street who runs things, not the government.

The votes in the House Financial Services Committee today underscore that point with stark clarity.

Today the Committee considered a slew of bills that tear down many of the Wall Street reforms passed in 2010. These reforms were already imperfect, as Wall Street sent the full force of its lobbying to the Hill in 2010 to compromise these reforms as much as possible.

Wall Street, having succeeded in 2010 in watering down the reforms meant to regulate them two years after they ruined the economy, did not rest. They have been lobbying nonstop since then to do everything they could to gut these reforms even more.

Today, nine deregulatory bills were considered, and nine were passed. The most egregious, HR 992, which we wrote about on Monday, passed 53-6. This bill is named "Swaps Regulatory Improvement Act", but it should be called, "If Banks Get Bailed Out, We'll Get Sold Out. Again." This is the bill that makes the cost of doing business for Wall Street lower by exploiting the implicit backing of the Federal Government. It allows banks to hold risky derivatives in the insured depository--that part of the bank that is insured by the FDIC. As we wrote yesterday, this is dangerous because derivatives are senior in bankruptcy--derivatives counterparties get paid out first.

Only six members of Congress, out of sixty-one total committee members, decided that this risk was too much. That Wall Street has won enough fights. Six out of sixty-one. The only six who dared to not roll over for Wall Street are: Rep Maxine Waters (@MaxineWaters) (D-CA), Rep Keith Ellison (@keithellison) (D-MN), Rep Steven Lynch (@RepStephenLynch) (D-MA), Rep Velazquez (@NydiaVelazquez) (D-NY), Rep Mike Capuano (@mikecapuano) (D-MA), and Rep Al Green (@RepAlGreen) (D-TX).

Those six were decidedly in the minority. Fifty-three members of Congress decided that, no, we really ought to make life even easier for the megabanks. The megabanks have it so hard, after all, right?

The banks have laundered money for drug cartels. They have deliberately lied to regulators. They have lied to Congress. They have illegally foreclosed on homes and then had their captured regulator give wronged parties a slap-in-the-face settlement of $300. They have manipulated global interest rates. They have sold predatory loans disproportionately to people of color . They have been bailed out. And they will not lay low.

Fifty-three members of the Financial Services Committee today decided that all this malfeasance, corruption and criminal activity is not only fine, but it should be rewarded. We should make life even easier for them. We should lower their cost of doing business on the backs of the US taxpayer. Only six decided that no, enough is enough.

It is the same old song in Congress. Wall Street owns them, and no amount of disgrace, shame, corruption and crime will deter the fifty-three members of this Committee from pledging allegiance to Wall Street.

Here is the complete list of the Financial Services Committee members. The official twitter for the Republicans on the Committee is @FinancialCmte, and the twitter for the Democrats is @FSCDems. Wall Street still runs things, but it is worth letting our captured Congressmembers know that we are fully aware that Wall Street also owns them.

Instagram photo posted by Mortgage Bankers Association lobbyist Len Wolfson during their fundraising ski trip with Rep Jeb Hensarling (R-TX) -- Memify this!

One might think that with the wave of scandals that have rocked the banking industry in the last several months, from HSBC money laundering to drug cartels, to the lies perpetuated in the JP Morgan London Whale trades, that politicians might have some sense of shame about continuing to deregulate on behalf of the banks. One might think that even if they are captured completely by their true bosses--Wall Street--that politically, they would have enough sense to go easy, lay low, and not carry the water for the banks so soon after this deluge of scandals.

You'd be wrong.

This Tuesday, the House Financial Services Committee will be reviewing nine bills that gut many of the reforms passed to regulate derivatives on Wall St in 2010. These bills vary in the specifics of their aims, but all effectively make profits easier for Wall Street, often at the expense of the American public.

As Mike Konzcal wrote for the Washington Post, “One bill would weaken cross-border regulations, allowing U.S. firms that run their derivatives in other countries to avoid following the new derivative rules. Another would exempt inter-affiliate swaps, or derivatives between various corporate entities, from having to follow the new Dodd-Frank derivative rules.”

But by far the most egregious of these bills is HR 992. Currently, banks can hold three kinds of derivatives in the same accounts as depositor funds--those that enjoy FDIC insurance. HR 992 would expand this to allow banks to hold ANY kind of derivative, with one exception (a structured swap, which is defined in the bill), in the insured depository.

The reason this is a problem is because derivatives are senior in bankruptcy. In the event a big bank went under, hedge funds sitting on the other side of trades with the bank would get money paid back to them first. If the hedge funds and other companies the bank traded derivatives with (what is technically called a “counterparty”) exhausted the funds set aside to insure the regular depositors (those with checking and savings accounts), the FDIC would have to 1) sell assets from the failed bank to raise money, and 2) try and fight to get back some of this money from the derivatives counterparties. If that didn’t work, the Treasury would step in and give a loan to the failed bank for 5 years--which essentially is a bailout. Banks want to hold their derivatives in the insured account because it makes it cheaper for them. HR 992 at its heart is about making the cost of doing business cheaper for Wall Street at the expense of Main Street.

These bills will most likely pass the Republican-controlled House Financial Services Committee. They will likely garner support from every Republican on the committee. Republican Randy Hultgren will certainly vote for his bill, HR 992 mentioned above. The head of the committee, Jeb Hensarling (known for a lavish ski vacation with Wall Street lobbyists). Another Republican, Scott Garrett, is also stuffed full of Wall Street cash, and will be sure to show his support for the banking lobby on Tuesday.

But there are also many Democrats who will likely vote for these bills. Jim Himes of CT (@jahimes) is a co-sponsor of one of the dangerous HR 992. David Scott of GA (@repdavidscott) is another co-sponsor, and he will also show allegiance to Wall Street on Tuesday. Carolyn Maloney of New York (@RepMaloney), will also likely vote on behalf of the banks, as she has proven a long-time ally of Wall Street.

Despite the fact that the ongoing wave of banking scandals demonstrate that the megabanks willfully violate existing laws, politicians on both sides of the aisle remain ready and willing to march ahead on their behalf, tearing down even the meager protections put in place after the financial crisis.

The bipartisan support for these bills shows that Wall Street still runs the show. And it also shows that even in the wave of revelations of money laundering by banks to drug cartels, politicians are still willing to risk populist rage in order to demonstrate where their ultimate allegiance lies. The banks remain so powerful, that Democrats and Republicans alike are willing to risk their re-elections rather than stand up to the criminals on Wall Street who give them their marching orders.

If you are prepared to object to the unholy union of big business and the United States government, we implore you to join us in Albany, Tuesday, May 7th when Reverend Billy will preside over the ceremony to wed big business and government in a celebration even the wedding industrial complex would love. Since the law considers corporations people, then why can't they marry one?

We need you to show up in the streets with us on Tuesday to show Albany that we will not allow our democratic process to continue to be directed to serve the interests of big business and the 1%. We need more, we deserve better, and we are demanding a structural change in our elections. How many more years must we suffer the results of legislators who govern with the fingers of capital around their throats? How many more resources must we lose to the 1% and big business?

We live in a world that is defined at every moment by big business. From destroying local business communities, to enslaving our bodies to the pharmaindustry, the quality of our lives are determined by strategic plans drafted to serve the relentless building of capital.

Through the policies and candidates purchased through legislative loopholes and the coffers of cash found on K Street, our modern world is not one with with a separation of big business and state, but one of total devotion between these two massive entities.

At last we will witness the happiness to be found between offshore money and onshore servitude. On the same day in which those who choose to support the status quo by holding a sham hearing, activists will be in force to defend a publicly demanded system that continues to serve the community of New York City. It is called "public financing" and what it means is that elections are financed with money from the local community, not funds from mysterious LLCs with corporate financiers hiding in the shadows.

Join us and say no. Join us and demand a better system in New York State. We can lead the way to a new playing field in the United States that serves the people by rendering impotent the power of corporations with profits that outsize the GDP of many countries.

"All contributions by corporations to any political committee or for any political purpose should be forbidden by law," proclaimed Theodore Roosevelt. Certainly we can finally finish this fight, over a century later when we enter Room 124 of the State Capitol Building with our signs to show that the people should always contribute testimony on legislation that directly affects us.

Join the bus leaving from Union Square, Tuesday morning, in NYC.

Demand better for all of us. Just get on the bus.

Last year Burger King made $117,000,000 in profits. Walgreens made $253,000,000.

Hundreds of fast food workers in NYC & Chicago recently participated in a strike to demand $15/hr. It is time to bring the Fight for Fifteen campaign to Oakland.

We will gather at Oscar Grant Plaza at 14th St. & Broadway for a rally on Wed, May 1st at 5 PM for a rally followed by a noise demo march throughout downtown Oakland at 6 PM. There will be food at the rally and also after the march back at the Plaza.

With the cost of rent driven up by gentrification, plus childcare, healthcare and other bills, $8/hour is not enough to survive in Oakland. Mayor Jean Quan says Oakland is “rising” but the lowest paid workers, who are more likely to be people of color and women, are left behind.

$15/hr livable wage for all Oakland workers!

Expose the practices of corporations who thrive off of low wage labor.

And, as we all know, whatever they do in back east, we can do better in Oakland.
